General Terms and Conditions of Sale

These general terms and conditions of sale are entered into, on the one hand, by EURL ONDES ET PROTECTION®, whose registered office is located at Pey Marty, 44 chemin de la Serre, 09130 CARLA BAYLE, France; and on the other hand, by any natural person wishing to make a purchase via the Ondes et Protection website, hereinafter referred to as “the Customer.”

ARTICLE 1: Scope

These general terms and conditions of sale apply to all orders placed on the websites ondesetprotection.com or protectagainstwaves.com. Any order placed through this site (regardless of the ordering method) implies unreserved acceptance by the Customer of these terms and conditions. These terms of sale shall prevail over any other general or specific conditions not expressly approved by ONDES ET PROTECTION. ONDES ET PROTECTION reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer. These general terms and conditions are concluded for the duration necessary for the supply of the items.

ARTICLE 2: Products and Availability

The items offered are those listed on the site ondesetprotection.com.

Availability Our product and price offers are valid as long as they are visible on the site, within the limit of available stocks.

Descriptions The descriptions of the items (photographs, information, text, etc.) in the catalog are as accurate as possible but cannot guarantee perfect similarity with the product offered, particularly regarding colors. Furthermore, as our items are handcrafted by artisans, they may present irregularities that shall in no case be considered defects.

ARTICLE 3: Pricing

Prices listed in the catalog are in Euros (€) and apply to all destinations, including non-Euro zones. ONDES ET PROTECTION reserves the right to modify its prices at any time, provided that the price listed in the catalog on the day of the order shall be the only one applicable to the buyer. The price is payable in full and in a single installment upon ordering. All orders are invoiced and payable in Euros.

ARTICLE 4: Disclaimer and Health Warning

The items sold on the Ondes et Protection® website are intended to limit the impact of electromagnetic waves. They do not eliminate their presence or their effects. Wearing these garments does not constitute a guarantee of health, care, or healing of any symptom or disease whatsoever. Ondes et Protection® shall not be held liable for any change in a customer’s health status. In the event of health problems, it is essential to consult a physician.

ARTICLE 5: Shipping Costs

Shipping costs are calculated based on the actual rates charged by carriers, according to the weight of the items ordered plus packaging, and are the responsibility of the Customer.

ARTICLE 6: Ordering Process

The Customer may place an order via:

Internet: At www.ondesetprotection.com. The buyer must: build an online “cart,” accept these general terms of sale, validate the order after checking it, and complete the payment.
Telephone: By calling Customer Service.

ONDES ET PROTECTION will confirm orders placed by phone or mail via email. Security Note: ONDES ET PROTECTION states that no person representing the company will call customers to ask for bank details or confidential access codes. We decline all responsibility for the fraudulent use of bank details wrongly shared by customers. Order confirmation implies acceptance of these terms, acknowledgment of full knowledge thereof, and waiver of the right to rely on one’s own purchase conditions.

Delivery Times: * Mainland France: 48h to 72h on average for orders placed before 11 AM (Mon-Fri).

Europe: 4 to 5 business days on average.
Outside Europe: 8 to 10 business days on average.
Mondial Relay: 8 days on average in France and Europe.

ARTICLE 7: Right of Withdrawal

In accordance with the law, the Customer has a 14-day withdrawal period from receipt of the order to request a return and refund, excluding shipping and return costs. The Customer must contact Customer Service to notify them of the withdrawal. Items must be returned at the Customer’s expense within 14 days. Conditions for Return: Items must be new, unused, in their original packaging, unsoiled, unwashed, and with the tag attached. Failure to comply cancels the refund eligibility. Refunds are processed using the original payment method within 14 days of receipt of the returned items. Note: This right does not apply to custom-made or personalized items.

ARTICLE 8: Exchanges

For exchanges due to customer error (size, color, change of mind), return shipping costs for the replacement item are the responsibility of the Customer. The Customer must contact Customer Service in writing within 5 days of receipt. ONDES ET PROTECTION is not obliged to satisfy the request and will confirm the exchange terms in writing if accepted.

In the event that an order is sent to a third party and/or to an address other than the buyer’s, the buyer remains solely responsible for managing the return process should it become necessary (non-transferable responsibility)

ARTICLE 9: Payment Methods

Payment can be made by:

Credit Card
PayPal: Secure transaction via PayPal’s server; no banking information passes through our site.
Bank Transfer: To the ONDES ET PROTECTION account.
Check: In Euros, payable by a French bank, to the order of ONDES ET PROTECTION. Note: Orders by check or transfer are processed only after the funds have cleared.

ARTICLE 10: Delivery

Delivery is made to the address provided during the order. The Customer is responsible for the accuracy of the delivery details. Any costs resulting from an address error will be charged to the Customer. Important: Mentions such as “subject to unpacking” are not legally valid. In case of damage, you must REFUSE the delivery and write “REFUSED DUE TO DAMAGE” on the delivery slip.

ARTICLE 11: Warranty

All products are new and covered by the legal warranty (Articles 1641 et seq. of the French Civil Code). In case of non-conformity, we will replace or refund the item. The warranty applies to normal use and excludes natural wear and tear or misuse.

ARTICLE 12: Liability

In the online sales process, ONDES ET PROTECTION is bound only by an obligation of means. It cannot be held liable for damages resulting from the use of the internet (data loss, intrusion, viruses, service interruption).

ARTICLE 13: Intellectual Property

All elements of the websites www.ondesetprotection.com and protectagainstwaves.com remain the exclusive intellectual property of ONDES ET PROTECTION. No one is authorized to reproduce, exploit, or use any part of the site (software, text, visuals) without express written consent.

ARTICLE 14: Data Archiving

ONDES ET PROTECTION archives purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with Article 1348 of the Civil Code.

ARTICLE 15: Personal Data

In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access and rectify their personal data. We collect information for order processing and delivery (sharing details with La Poste or carriers).

ARTICLE 16: Governing Law and Jurisdiction

These online terms of sale are subject to French law. In case of dispute, jurisdiction is assigned to the competent courts of Foix (09000).

ARTICLE 17: Customs and Taxes

Orders delivered outside of France may be subject to local taxes and customs duties. These costs are the sole responsibility of the Customer. We advise you to contact your local authorities for information.

ARTICLE 18: Force Majeure

ONDES ET PROTECTION shall not be held liable for failure to perform the contract due to force majeure, strikes (postal/transport services), or disasters (floods, fires).

ARTICLE 19: Brand Protection

The brand and website www.ondesetprotection.com are protected under intellectual property laws. Any unauthorized reproduction constitutes an infringement.
