These general conditions of sale are concluded on the one hand by EURL PROTECT AGAINST WAVES®, whose head office is located at the place called Peymarty 09130 CARLA BAYLE, and on the other hand, by any natural person wishing to make a purchase via the Ondes et Protection website, hereinafter referred to as “The Customer”.
SECTION 1
These general conditions of sale apply to all orders placed on the protectagainstwaves.com website.
Any order made through this site (and whatever the mode of order) implies an acceptance without reserve by the customer of these conditions of sale. These conditions of sale shall prevail over any other general or specific conditions not expressly approved by ONDES ET PROTECTION.
ONDES ET PROTECTION reserves the right to be able to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
The general conditions of sale are concluded for the duration necessary for the supply of the articles.

Ondes et protection® cannot be held responsible for any change whatsoever in the state of health of one of its clients. In the case of health problems, it is essential to consult a doctor. ONDES ET PROTECTION stipulates that no person referring to it will call customers to ask for bank details or confidential access codes that only customers know and declines all responsibility in the event of misuse or fraudulent use. bank references that would be wrongly communicated by the customer(s).
The confirmation of the order entails the acceptance of these general conditions of sale, the recognition of having perfect knowledge of them and the renunciation of availing oneself of its own conditions of purchase or other conditions.

The delivery time for orders placed through the website and sent by post is on average, in mainland France, 48 to 72 hours, for all orders placed before 11 a.m., Monday to Friday.
For shipments to Europe, the average delivery time is 4 to 5 working days. Outside Europe, the average delivery time for these shipments is 8 to 10 working days.
Shipments made by Mondial Relay take an average of 8 days, in France and in Europe.
ARTICLE 7
In accordance with the law, the Customer has a withdrawal period of 14 days from receipt of his order to request a return and refund of the product from ONDES ET PROTECTION, with the exception of shipping costs. and forwarding and at the price in force on the day of the order.
To use his right of withdrawal, the Customer must contact the Customer Service to inform him of his withdrawal.
The Customer must imperatively return to ONDES ET PROTECTION the items ordered, at his expense, within 14 days. Any return request received by ONDES ET PROTECTION beyond this 14-day period, for any reason whatsoever, cannot be accepted.
Returned items must be new, unused and in their original packaging and the item must not have been worn, soiled, washed, and the label must be attached to the product. The refund will take place after the item(s), for which the right of withdrawal is requested, have been returned to us and within 14 days.

SECTION 8
In the event of a return desired by the customer for an exchange, following a purchase error (size, colour, etc.) or a change of mind, and when our stocks allow us to exchange, the shipping costs of shipping of the replacement item(s) is the customer’s responsibility.

SECTION 9
The Customer has means of payment offering maximum security.
An order can be set by:

- Transfer to the ONDES ET PROTECTION account
- check in euros, payable by a French bank, payable to ONDES ET PROTECTION and addressed to Ondes et Protection ld Peymarty 09130 Carla BAYLE.
Please note : by choosing to pay by check or by bank transfer, the order will only be processed after collection and the deadlines will only begin from this moment.
Before validating the method of payment and continuing with the order, the Customer is invited to carefully check all the information entered by him in the areas provided for this purpose.
An irregular declaration or an anomaly may be subject to specific treatment. Thus, proof of address and identity may be requested.
SECTION 10
Delivery is made to the address indicated when ordering. Deliveries will be entrusted to the post office or to Mondial Relay.
The Customer is responsible for the accuracy of the delivery details he has registered on the site. All costs inherent in an error of coordinates will be at his expense.
If a parcel was returned to us following an error of co-ordinates or with an unspecified responsibility of the customer, this parcel will be able to be forwarded to the address indicated by this one after payment of the carriage costs with the real one (according to the weight of the parcel, its destination and the mode of forwarding retained);
In the event that the Customer does not wish to be reshipped and chooses to have his order reimbursed, the shipping costs charged by the carrier engaged for the shipment will be deducted from the reimbursed value.
The words“subject to unpacking“,“packaging in good condition” … are not valid in case of dispute: in case of damage on a delivery REFUSE the delivery and note on the delivery note“REFUSE FOR DAMAGE“.
SECTION 11
All the products supplied by the seller are new and benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code.
If it happens that an article is non-compliant, we undertake to replace it or refund it.
The warranty applies to normal use. Damage caused by natural wear and tear or misuse of the product by the customer does not fall within the contractual scope of the warranty.

SECTION 18
PROTECT AGAINST WAVES cannot be held responsible for non-performance of the contract concluded due to force majeure, in the event of a total or partial strike of postal services or carriers, or disasters such as floods or fires.
The choice and purchase of a product are placed under the sole responsibility of the customer. The total or partial impossibility of using the products cannot give rise to any compensation, reimbursement or questioning of the liability of ONDES ET PROTECTION, except in the case of a proven hidden defect, non-compliance, defect or exercise of the right of withdrawal envisaged under article 6.
SECTION 19

Settlement of a dispute by amicable mediation
